Terms of Service

These terms cover your use of the Spek Screens web app (screens.spekapps.com), the Spek Videos web app (videos.spekapps.com) and the Spek Podcasts web app (podcasts.spekapps.com), made by Blair ("Spek," "we," "us"). By using the apps, you agree to these terms. If you don't agree, please don't use the apps.

Plain-language summary: these are free apps offered as-is. Use them reasonably, and understand there are no guarantees. The sections below are the formal version.

Using the apps

None of the apps needs an account. Spek Screens keeps your lists in your browser; Spek Videos and Spek Podcasts keep them in an anonymous account tied to your browser. Signing in with a Google account is optional, and only needed to keep your lists in sync across devices; while the apps are being tested, it's by invitation. If you sign in, you'll set a passphrase that encrypts your saved lists; keep it, and the recovery code you're given, somewhere safe — Spek can't read or recover them, so without either your saved lists can't be unlocked. If you sign in, you're also responsible for keeping your account secure and for what happens under it. Please use the apps only for lawful, personal purposes, and don't try to break, overload, misuse, or gain unauthorized access to them or to other users' data.

The apps are currently offered free of charge while in a small testing phase.

Your content and data

Your saved preferences and activity remain yours. How we handle that information is described in our Privacy Policy. You can delete your data at any time from the Account section of each app.

Third-party services and content

The apps rely on and display content from third-party services — including Google/YouTube, The Movie Database (TMDB), Apple's podcast directory and each podcast's own host — and link to other sites. We don't control those services or their content, and we're not responsible for them. Spek Videos uses YouTube API Services: by using Spek Videos, you agree to be bound by the YouTube Terms of Service, and Google's handling of your information is described in the Google Privacy Policy. Movie and show information and images are provided by TMDB, which does not endorse Spek. In Spek Podcasts, podcasts, their artwork and their audio belong to their creators and are read from each show's own feed; Spek doesn't host them. Show search uses Apple's public podcast directory.

Availability and changes

The apps are provided "as is" and "as available." We may change, suspend, or discontinue any part of them at any time, and we may limit or end access to an account. We don't guarantee the apps will always be available, error-free, accurate, or uninterrupted.

No warranties

To the fullest extent allowed by law, the apps are provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. You use the apps at your own risk.

Limitation of liability

To the fullest extent allowed by law, Spek and its maker will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising out of or related to your use of the apps. Because the apps are provided free of charge, our total liability to you for any claim is limited to the amount you paid to use the apps — which is nothing.

Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there, without regard to conflict-of-law rules. Any disputes will be handled by the courts located in Ontario, Canada.

Changes to these terms

We may update these terms from time to time. When we do, we'll change the date at the top. Continuing to use the apps after a change means you accept the updated terms.
